Archived terms and conditions

On 1 July 2009 legislative changes to privacy and the Freedom of Information Act were enacted. These changes necessitated changes to the standard procurement terms and conditions.  
Copies of new standard terms and conditions for use from 1 July 2009 are available here.

For all procurement processes entered into prior to 1 July 2009, the existing contract remains under the agreed terms and conditions. The following terms and conditions were available for Queensland Government agencies and suppliers to use prior to 1 July 2009 and are archived here for your reference.

One-off purchases

The terms and conditions of one-off purchases developed for a one-off purchasing process between an agency and supplier for goods and/or services:

Short Form - Conditions of Contract for low-value/low-risk purchases for use when an agency is contracting with a supplier for goods and/or services with a low degree of 'difficulty of securing supply' and a 'low expenditure' relative to the total procurement spend.

Short Form - Conditions of Contract (including Schedule) contains the same contractual terms and conditions as the Short Form - Conditions of Contract, however this document refers to the enclosed Schedule which, when completed by the agency, will form part of the Contract.

Complementing the above terms and conditions, the Additional Provisions document contains various precedent/template clauses, schedules and notices that deal with such issues as the mail security screening requirements, sustainability, professional contractors (previously known as consultants) and quality assurance.

Information and Communications Technology (ICT) products and services

The terms and conditions of the Information and Communication Technology (ICT) Standing Offer Arrangement incorporate offer and arrangement conditions, and also link the contractual conditions of the Government Information Technology Contracting (GITC) Framework Version 5.
